(8) 21­0064 ENERGY AND ENVIRONMENT COMMITTEE REPORT report relative to the Final Program Environmental Impact Report (PEIR) for the Comprehensive Plastics Reduction Program (Program), California Environmental Quality Act (CEQA) Findings, and related matters. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: 1.  REVIEW and CONSIDER the information contained in the Final PEIR for the proposed Program, comprised of the Draft PEIR with minor modifications indicated, comment letters received on the Draft PEIR and responses to the comments reflected in the September 5, 2024, Bureau of Sanitation (BOS) report, attached to the Council file, and any other information in the record of proceedings; and, CERTIFY that the Final PEIR was completed in compliance with the CEQA; that potentially significant environmental effects of the proposed Program have been disclosed and evaluated in compliance with the CEQA; and, that the Final PEIR reflects and expresses the City’s independent judgment and analysis as the CEQA Lead Agency. 2.  ADOPT the proposed Program’s CEQA Findings, including the Statement of Overriding Considerations in Section 4 of the CEQA Findings and the Mitigation Monitoring Report in Section 5 of the CEQA Findings, as detailed in the September 5, 2024 BOS report, attached to the Council file. 3.  SPECIFY that the documents constituting the record of proceedings in this matter are located at the Office of the City Clerk, 200 North Spring Street, 3rd Floor, Los Angeles, California 90012; the - October 1, 2024 - reflects and expresses the City s independent judgment and analysis as the CEQA Lead Agency. 2.  ADOPT the proposed Program’s CEQA Findings, including the Statement of Overriding Considerations in Section 4 of the CEQA Findings and the Mitigation Monitoring Report in Section 5 of the CEQA Findings, as detailed in the September 5, 2024 BOS report, attached to the Council file. 3.  SPECIFY that the documents constituting the record of proceedings in this matter are located at the Office of the City Clerk, 200 North Spring Street, 3rd Floor, Los Angeles, California 90012; the Department of Public Works, BOS, Solid Resources Citywide Recycling Division, 1149 South Broadway, 5th Floor, Los Angeles, California 90015; and any other relevant City departments. 4.  APPROVE the proposed Program as described in Section 2 of the Final PEIR, reflected in the September 5, 2024 BOS report, attached to the Council file, on a programmatic basis subject to subsequent City Council approval for the individual proposed Program items. 5.  DIRECT the BOS to report on proposed definitions, impacted entities, implementation schedules, and compliance approaches for the following upstream source reduction measures: Reusable Foodware for Dine­in services, Recyclable or Compostable Single­ Use Take­Out Foodware, and Single­Use Printer Cartridges Ban. The information provided by the BOS should be based on the upstream measures evaluated in the Final PEIR, and their experience in implementing source reduction ordinances citywide and current waste management operations within the City. The report is to be submitted to the Energy and Environment Committee for their review and consideration. Emphasize in the report the engagement with restaurants of various sizes, service formats, geographies around the City so that they can advise on expected costs, recommended timelines for compliance, using an education first approach, and potential need for exemptions or waivers if needed, etc. Engage facilities with dine­in cafeterias such as hospitals, and how to advise on how to phase in street vendors as appropriate. 6.  DIRECT the BOS to report with the scope of work, financial resources and contractual services resources needed to effectuate a reusable and returnable takeout foodware program, inasmuch as this is just a scope of work, financial resources, etc., not an actual program yet. In both cases, DIRECT the BOS to coordinate with the County of Los Angeles and other local jurisdictions, as they have already implemented similar measures to learn from their experience and incorporate best practices. 7.  DIRECT the BOS to prepare an outreach program to inform and educate consumers and businesses about the proposed draft - October 1, 2024 - 6.  DIRECT the BOS to report with the scope of work, financial resources and contractual services resources needed to effectuate a reusable and returnable takeout foodware program, inasmuch as this is just a scope of work, financial resources, etc., not an actual program yet. In both cases, DIRECT the BOS to coordinate with the County of Los Angeles and other local jurisdictions, as they have already implemented similar measures to learn from their experience and incorporate best practices. 7.  DIRECT the BOS to prepare an outreach program to inform and educate consumers and businesses about the proposed draft ordinances, as requested by the Council. 8.  INSTRUCT the City Administrative Officer (CAO) to report on the feasibility of regularizing the following six positions and adding one position in Fiscal Year 2025­2026, and to identify these positions as critical to public health and the environment. a.  The six Resolution Authority positions: i.  One Environmental Affairs Officer ii.  One Environmental Supervisor II iii.  Three Environmental Specialists iv.  One Principal Public Relations Representative b.  Add one Environmental Compliance Inspector. 9.  REQUEST the Los Angeles Department of Water and Power, and INSTRUCT the Department of General Services and Department of Recreation and Parks, to provide a comprehensive report on the deployment of hydration stations equipped with drinking water dispensers and bottle filling mechanisms at City facilities and events, city parks, rights of way, and other appropriate locations where such stations would be readily accessible to the general public. Fiscal Impact Statement: None submitted by the BOS. Neither the CAO nor the Chief Legislative Analyst has completed a financial analysis of the report. Community Impact Statement: None submitted.
