(9) 221426S1 CD 15 ADMINISTRATIVE EXEMPTION and TRADE, TRAVEL AND TOURISM COMMITTEE REPORT \nrelative to the Second Amendment to Reimbursement Agreement No. 193706 between the Port of \nLos Angeles (POLA) and San Pedro Public Market LLC (SPPM) for the reimbursement (POLA) and \nSan Pedro Public Market, LLC (SPPM) for the reimbursement of staff and consultant costs associated \nwith the preparation of an environmental assessment associated with the West Harbor (formerly know \nas San Pedro Public Market) Modification Project. Recommendations for Council action: \n1. ADOPT the determination by the Board of Harbor Commissioners (BOHC) that this action is administratively \nexempt from the California Environmental Quality Act (CEQA) pursuant to Article II, Section 2(f) of the Los \nAngeles City CEQA Guidelines. \n2. APPROVE the Second Amendment to Reimbursement Agreement No. 193706 between the POLA and SPPM, to extend \nthe contract term by an additional two years from December 10, 2024 through December 9, 2026, for a total term \nof seven years; and, increase compensation by $30,000, from $795,000 for a new contract authority of $825,000, \nto complete an environmental assessment for proposed improvements, including the addition of a concert venue, \nat the San Pedro Waterfront. \n3. CONCUR with the BOHC action on August 22, 2024, by POLA Resolution No. 2410413, \nauthorizing the Executive Director, POLA, or designee, to execute the proposed Second Amendment to Reimbursement \nAgreement No. 19 3706. Fiscal Impact Statement: The City Administrative Officer reports that under the Agreement \nterms, SPPM is required to reimburse the POLA for all staff and consultant costs, and any legal defense costs associated \nwith the preparation of the environmental assessment to incorporate analysis of the proposed improvements and development \nof a concert venue associated with the West Harbor (formerly known as San Pedro Public Market) Modification Project. SPPM \nis responsible for any cost estimate increase that may occur during the evaluation. Initial payments from the POLA for \nconsultant costs and project fees are recognized as receivables to Account No. 11225 (Reimbursable Costs Env Projects), \nCenter No. 7000 (Balance Sheet), Program No. 000 (Base Budget). The POLA bills SPPM monthly as expenses are incurred The \ntotal revenues to be SPPM monthly as expenses are incurred. The total revenues to be received by the POLA for this Agreement \nis $825,000 and includes $600,668 in receipts through Fiscal Year 202324 and anticipated receipts of $224,332 through the end \nof the contract. The recommended actions comply with the POLA’s Financial Policies.
