(5)\n23-0600-S9\nCOMMUNICATIONS\nFROM\nTHE\nCITY\nATTORNEY\nand\nORDINANCES FIRST CONSIDERATION relative to amending Article\n6.1, Chapter VI of the Los Angeles Municipal Code to amend the MultiFamily Bulky Item Fee, the Solid Waste Collection, Transfer, Recycling,\nRecovery of Waste Resources, and Disposal Fee, and the Low Income\nCustomer Assistance Program, and amending Subsections (a) and (m)\nof Section 5.121.5 of Article 7, Chapter 6, Division 5 of the Los Angeles\nAdministrative Code to change the fund administrator for the Solid\nWaste Resources Special Revenue Fund and the Multi-Family Bulky\nItem Fee Special Revenue Fund.\nRecommendations for Council action, SUBJECT TO THE APPROVAL\nOF THE MAYOR:\n1. FIND that the California Environmental Quality Act (CEQA)\ndoes not apply to the creation of government funding\nmechanisms or other government fiscal activities that do not\ninvolve any commitment to any specific project that may result\nin a potentially significant physical impact on the environment;\nState CEQA Guidelines Section 15378(b)(4). The draft\nOrdinances are, therefore, not subject to CEQA because they\ndo "not involve any commitment to any specific project which\nmay result in a potentially significant physical impact on the\nenvironment." Any CEQA-defined projects constructed from the\nfunds received from the enactment of these ordinances will be\nsubject to a project-specific CEQA process before construction.\n2. PRESENT and ADOPT the accompanying ORDINANCE, dated\nSeptember 7, 2025, amending Subsections (a) and (d) of\nSection 66.40, Subsections (a) and (b) of Section 66.41, and\nSubsection A of Section 66.48, of Article 6.1, Chapter VI of the\nLos Angeles Municipal Code, to amend the Solid Waste\nCollection, Transfer, Recycling, Recovery of Waste Resources,\nand Disposal Fee and the Low Income Customer Assistance\nProgram, and amending Subsection (a) of Section 5.121.5 of\nArticle 7, Chapter 6, Division 5 of the Los Angeles\nAdministrative Code to change the fund administrator for the\nSolid Waste Resources Special Revenue Fund.\n3. PRESENT and ADOPT the accompanying ORDINANCE, dated\nSeptember 7, 2025, adding Subsections (f), (g), (h), and (i) to\nSection 66.40 of Article 6.1, Chapter VI, and amending\nSubsections (c) and (e), and repealing Subsection (f), of\nSection 66.41 of Article 6.1, Chapter VI of the Los Angeles\nMunicipal Code to amend the Multi-Family Bulky Item Fee, and\namending Subsection (m) of Section 5.121.5 of Article 7,\nChapter 6, Division 5 of the Los Angeles Administrative Code to\nchange the fund administrator for the Multi-Family Bulky Item\nFee Special Revenue Fund.\nFiscal Impact Statement: None submitted by the City Attorney. Neither\nthe City Administrative Officer nor the Chief Legislative Analyst has\ncompleted a financial analysis of this report.
