30.\nAUTHORIZATION TO\nNEGOTIATE AND EXECUTE\nA FACILITY USE\nAGREEMENT WITH ASOCIACIÓN DE JALISCIENSES UNIDOS EN ACCIÓN FOR\nSHORT-TERM USE OF THE CITY-OWNED NTMA FACILITY\n(PARKS AND RECREATION)\nRECOMMENDATION: It is recommended that the City Council:\n1) Determine that the proposed negotiation and execution of a Facility Use\nAgreement with Asociación de Jaliscienses Unidos en Acción (AJUA) for the\nshort-term use of designated spaces within the former National Tooling &\nMachining Association (NTMA) facility located at 12131 Telegraph Road\n(Agreement) is exempt from the requirements of the California Environmental\nQuality Act (CEQA) (Pub. Res. Code § 21000 et seq.) pursuant to CEQA\nGuidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) Section 15304 (Class 4 -\nMinor Alterations to Land) and Section 15061(b)(3) (Common Sense Exemption);\nand\n2) Authorize the City Manager to negotiate and execute the Agreement, for a monthly\namount of three hundred dollars ($300) and a term set to expire on March 31,\n2026, subject to City Attorney approval as to form; and\n3) Authorize the City Manager, in consultation with the City Attorney, to approve\nminor amendments and extensions to the Agreement as needed to ensure\ncontinuity of use; and\n4) Direct the City Attorney to make clarifying changes to the Agreement as necessary\nto effectuate the intent of the Agreement; and\n5) Take such additional, related action that may be desirable.
