20.\nWAIVE SECOND READING AND ADOPT ORDINANCE NO. 2485, AMENDING CHAPTER 8.32 OF THE\nMONTEBELLO MUNICIPAL CODE TO EXPAND THE PROHIBITION OF SMOKING TO INCLUDE PLACES\nOF EMPLOYMENT, PUBLIC SPACES AND OUTDOOR AREAS\nRECOMMENDATION: It is recommended that the City Council:\n1. Waive Second Reading and adopt Ordinance No. 2485, amending Chapter 8.32, entitled Smoking, of the\nMontebello Municipal Code (“MMC”), to expand the prohibition of smoking to include places of\nemployment, public spaces and outdoor areas, in order to protect public health and the environment; and\n2. Determine and Find that the project is exempt from the California Environmental Quality Act (“CEQA”)\npursuant to the “Common Sense” exemption set forth under Section 15061(b)(3), which provides that\nCEQA applies only to projects which have the potential for causing a significant effect on the environment,\nconsidering that it can be seen with certainty that there is no possibility that amending chapter 8.32 of the\nMMC will have a significant effect on the environment; and\n3. Take such additional, related, action that may be desirable.
