10B. Introduction of Ordinance No. 2023-03 adding Chapter 3.28\n(Cannabis Business Tax) to Title 3 of the Encinitas Municipal\nCode establishing a Tax on Cannabis and Hemp Business\nActivities within the City and adopting Resolution No. 2023-\n21 setting forth the Specific Tax Rates for the Cannabis\nBusiness Tax. Environmental Considerations: The\nOrdinance and Resolutions are exempt from the California\nEnvironmental Quality Act, Public Resources Code sections\n21000 et seq. ("CEQA") and 14 Cal. Code Regs. section\n15000 et seq. ("CEQA Guidelines"). The Ordinance and\nResolution are not projects within the meaning of CEQA\nbecause they create a government funding mechanism that\ndoes not involve any commitment to any specific project that\nmay result in a potentially significant physical impact on the\nenvironment, pursuant to CEQA Guidelines section 15378(b)\n(4). Further, it can be seen with certainty that this Ordinance\nwill not have a significant effect on the environment and is\ntherefore exempt pursuant to section 15061(b)(3).
