8E.\nAcceptance of the D Street Staircase Emergency Repair Project (CX25A).\nEnvironmental Considerations: The actions being considered by the City\nCouncil are exempt from the California Environmental Quality Act (CEQA)\nbecause they are not a "project" under Section 15378(b)(5) of the CEQA\nGuidelines because it can be seen with certainty that there is no possibility\nthat the activity in question may have a significant effect on the environment.\nThe actions are also exempt from CEQA under section 15378(b)(5) of the\nCEQA Guidelines because it involves an organizational or administrative\nactivity of government that will not result in the direct or indirect physical\nchange in the environment.  Contact Person: Senior Engineer Ben Stryker\nRecommended Action: 1) Authorize the filing of the Notice of Completion for\nthe subject project; 2) Authorize the release of the payment bond for the\nsubject project in full upon the recording of the Notice of Completion; 3)\nAuthorize the release of the performance bond for the subject project in full,\none (1) year after the recording of the Notice of Completion; 4) Adopt City\nCouncil Resolution No. 2026-11, titled "A Resolution of the City Council of the\nCity of Encinitas, California, Accepting the Public Improvements for the D\nStreet Staircase Emergency Repair Project (CX25A)"; and 5) Adopt City\nCouncil Resolution No. 2026-12, titled "A Resolution of the City Council of the\nCity of Encinitas, California, Amending the Fiscal Year 2025-26 Budget" to\nappropriate $1,007,419 to the D Street Staircase Emergency Repair Project\n(CX25A).\n2026-02-25 Item 08E D Street NOC Agenda Report
