4.1. Public Hearing for Adoption of Ordinance No. 23-02 to Amend Section 17.405.060\n(Accessory Dwelling Units) of the Development Code to Implement Senate Bill 897\nRECOMMENDATION:\nStaff recommends that the City Council take the following action:\n1. DETERMINE that the California Environmental Quality Act (“CEQA”) does not\napply to the approval or adoption of an Ordinance by a city or county\nimplementing the provisions of section 65852.2 of the Government Code, which\nis California’s ADU law, pursuant to California Public Resources Code section\n21080.17; and therefore, Ordinance No. 23-02 is statutorily exempt from the\nCEQA; and,\n2.
