Item 202:\nAppeal of the Environmental Determination for 710 Garnet Avenue Streetary\nProject No. PRJ-1126697.\nThis item will be considered in the afternoon session which is scheduled to begin at\n2:00 p.m.\nTotal Estimated Cost of Proposed Action and Funding Source:\nNo fiscal impact. All costs associated with the processing of the application are recovered\nthrough a deposit account funded by the applicant.\nCouncil District(s) Affected: 1.\nProposed Actions:\nAppeal of the Environmental Exemption determination pursuant to California\nEnvironmental Quality Act (CEQA) State Guidelines, Section 15332, In-fill Development\nProjects, for a Coastal Development Permit to permit and modify an existing streetary for\nthe 710 Garnet Avenue Streetary Project on a 760 square-foot project site located within\nthe public right-of-way in front of an existing restaurant (710 Beach Club) at 710 Garnet\nAvenue within the CV-1-2 (Commercial Visitor) zone, Coastal Height Limit Overlay\nZone, Coastal Overlay Zone (Appealable Area, First Public Roadway), Parking Impact\nOverlay Zone, Transit Area Overlay Zone, Parking Standards Transit Priority Area, and\nTransit Priority Area within the Pacific Beach Community Plan and Local Coastal\nProgram Land Use Plan. The only issue before the City Council is the appeal of the\nenvironmental determination and not the project.\nAccording to San Diego Municipal Code Section 112.0520(e) Power to Act on Appeal,\nthe City Council shall consider the appeal and may:\n(1) By a majority vote, deny the appeal and approve the environmental determination that\nthe project is exempt from the California Environmental Quality Act (CEQA) pursuant to\nGuidelines Section 15332 (In-Fill Development Projects); or\n(2) By a majority vote, grant the appeal and set aside the environmental determination in\naccordance with San Diego Municipal Code Section 112.0520(f);\nDirecting the City Attorney to prepare the appropriate resolution according to Section 40\nof the City Charter;\nIf the City Council grants the appeal, the City Council shall retain jurisdiction to act on\nthe revised environmental determination and associated project at a subsequent public\nhearing.\nThis item is not subject to the Mayor's veto.\nCommittee Actions Taken: N/A\nDevelopment Services: Travis Cleveland, (619) 446-5407\nCity Attorney Contact: Jeanne MacKinnon
