12. Public Hearing, Making CEQA Exemption Determinations, and Approving, Setting, and\nproviding for Annual Cost Increases to Affordable Housing Development Impact Fees.\nConsider approval of the Development Impact Fee (DIF) Nexus Study for affordable housing\nlinkage and in-lieu fees, establishment of maximum legally defensible fee levels, setting initial\nfees, and direction to the City Manager to negotiate applicable fees through development\nagreements on a project-by-project basis as applicable.\nRecommendation: That the City Council:\n1. Conduct a public hearing on the proposed Development Impact Fee update; and\n2. Find that the actions proposed herein are statutorily exempt from the California\nEnvironmental Quality Act (CEQA) pursuant to State CEQA Guidelines section 15378 (b)\n(4), 15061 (b) (3), and 15273 (Rates, Tolls, Fares, and Charges); and\n3. Adopt a resolution titled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF\nLA VERNE, CALIFORNIA, APPROVING THE AFFORDABLE HOUSING LINKAGE & IN-\nLIEU DEVELOPMENT IMPACT FEE JUSTIFICATION STUDY AND SETTING INITIAL\nFEES"; and\n4. Approve a justifiable per square foot fee and provide authority to the City Manager to\nnegotiate and determine an applicable fee amount on a project-by-project basis; and\n5. Approve annual adjustments tied to the California Construction Cost Index (CCCI) to\naccount for inflation in construction and acquisition costs.
