8B. PUBLIC HEARING TO CONSIDER INTRODUCING (FIRST READING) OF ORDINANCE NO. 1804, FOR THE CONTINUANCE OF THE TEMPORARY PARKLET PROGRAM AND AN AMENDMENT OF THE PARKLET DESIGN STANDARDS AND TO CONSIDER THE PROJECT CATEGORICALLY EXEMPT FROM THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nPublic hearing for the City Council to consider introducing and conducting a first reading of an ordinance to amend Municipal Code Title 17 (Zoning) for an extension of the Parklet Dining Program to January 1, 2029, and to adopt a resolution that updates the maximum quantity, parklet design standards, fees, and enforcement procedures of the parklet program.\nThe City Council will also consider whether the project is Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines § 15321: Enforcement Actions by Regulatory Agencies and § 15311: Accessory Structures.\nRecommended Action\n1. Determine the Ordinance Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections § 15321: Enforcement Actions by Regulatory Agencies, and Section § 15311: Accessory Structures.\n2. Introduce, and conduct a first reading, by title only, of Ordinance No. 1804 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AMENDING SECTION 17.28.206 OF THE SAN CLEMENTE MUNICIPAL CODE, REGULATING TEMPORARY PARKLET DINING, WHICH ESTABLISHES STANDARDS FOR OUTDOOR DINING AREAS AND SUNSETS ON JANUARY 1, 2029; AND FINDING THIS ACTION EXEMPT FROM CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTIONS 15311 AND 15321.
