11J. CONSIDERATION OF A RESOLUTION APPROVING AN EXEMPTION TO THE FORMAL SOLICITATION PROCESS, APPROVING A MEMORANDUM OF UNDERSTANDING WITH THE CALIFORNIA JOINT POWERS INSURANCE AUTHORITY TO PARTIALLY FUND AN AMERICANS WITH DISABILITIES ACT SELF-EVALUATION AND TRANSITION PLAN UPDATE, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT IN AN AMOUNT NOT TO EXCEED A COST TO THE CITY OF $263,350, APPROVING A RELATED BUDGET APPROPRIATION, AND FINDING THE PROJECT EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.\nRecommended Action\nAdopt Resolution No. 26-74, which will:\n1. Approve an exemption to the formal solicitation process within the City’s Purchasing Policy (Section XI A.1.1.14).\n2. Approve the Memorandum of Understanding with the California Joint Powers Insurance Authority in the amount of $286,850, with the City’s portion of cost being $263,350, to have Disability Access Consultants evaluate the City’s programs, facilities, and rights-of-way, and provide an updated ADA self-evaluation and transition plan for City facilities, programs, and public rights-of-way in accordance with the proposal dated March 28, 2026 (Attachment 2).\n3. Approve, and authorize the City Manager to execute, Contract No. C26-33, Memorandum of Understanding, by and between the City of San Clemente and the California Joint Powers Insurance Authority, providing for Disability Access Consultants to evaluate the City’s programs, facilities, and rights-of-way, and provide an updated ADA self-evaluation and transition plan for City facilities, programs, and public rights-of-way in accordance with the proposal dated March 28, 2026, in an amount not to exceed cost to the City of $263,350.\n4. Approve a supplemental appropriation of $263,350 from General Fund Balance to Account No. 001-421-43890.
