16. 26-54807\nRecommendation to authorize City Manager, or designee, to execute an Estoppel\nand Recognition Agreement in favor of MCRT Investments LLC (or an affiliate)\n(MCRT) in connection with the transfer and development of the Mid Block Site at\n321 West Ocean Boulevard;\nAuthorize City Manager, or designee, to execute an amendment to the Second\nAmended and Restated Conveyance Agreement (Contract No. 35331) with MCRT\nand Plenary Properties Long Beach LLC to, among other things, recognize\nMCRT’s rights to the Mid Block Site and provide for project phasing;\nAuthorize City Manager, or designee, to execute an Indemnification and\nReimbursement Agreement with MCRT to, among other things, allow for MCRT to\nfulfill City’s existing obligation under the Civic Center Project Agreement to\nremediate certain impacted soil existing on the Mid Block Site;\nAuthorize City Manager, or designee, to execute a Waterline Easement Agreement\nwith MCRT Investments LLC (or an affiliate) to, among other things, allow for the\nCity to install and maintain a water pipeline and related facilities on a portion of the\nMid Block Site;\nAuthorize City Manager, or designee, to execute an Access Agreement with MCRT\nInvestments LLC (or an affiliate) to, among other things, allow MCRT and its\ncontractors to access City-owned property for the purposes of installing public\nimprovements required in connection with the project;\nAuthorize City Manager, or designee, to execute an Easement Agreement with\nMCRT Investments LLC (or an affiliate) to, among other things, allow for the\ninstallation of landscaping, hardscaping and a fire lane on a portion of City-owned\nproperty;\nAdopt resolution approving deferral of up to $1,799,917, in development impact\nfees to be collected at the completion of Phase Two of the project in recognition of\ninfrastructure completed early in Phase One;\n26-54808\nAdopt resolution approving an “Other Alternative Compliance Method” request\nunder the City’s Inclusionary Housing Ordinance for a 729 unit housing\ndevelopment project located at 321 West Ocean Boulevard, to allow the option for\ninclusion of seventy-three (73) Moderate-Income (MI) level affordable units (10\npercent MI affordability) instead of the standard requirement of forty-four (44) Very-\nLow-Income (VLI) and forty-four (44) Low-Income (LI) level affordable units (12\npercent total affordability) for the affordability requirement pursuant to Section\n21.67.080(C) of the Long Beach Municipal Code and adopting related findings\nthereto; and\nAuthorize City Manager, or designee, to execute such other documents,\nagreements, or maps as are reasonably necessary to effectuate the transfer and\ndevelopment of the Mid Block Site.
