Item 102:\nFirst Amendment to Agreement for Legal Services with Jarvis Fay LLP to Provide\nContinuing Legal Services as Outside Counsel.\nTotal Estimated Cost of Proposed Action and Funding Source:\nThe First Amendment to the agreement with Jarvis Fay LLP will increase the not-to-\nexceed amount by $1,000,000 for a total not-to-exceed amount of $1,500,000.\nExpenditure of funds from the enterprise funds, the Public Liability Fund, or the General\nFund are contingent upon adoption of the Annual Appropriation Ordinance for the\napplicable Fiscal Year, contingent upon the Chief Financial Officer certifying that funds\nnecessary for expenditure are, or will be, on deposit with City Treasurer.\nCouncil District(s) Affected: Citywide.\nProposed Actions:\n(R-2026-393)\nResolution authorizing approval of a First Amendment to Agreement for Legal Services\nwith Jarvis Fay LLP to Provide Continuing Legal Services as Outside Counsel to provide\nlegal services to the City pursuant to City Council Resolution R-315085 that authorized\nthe Agreement with Law Firm in the areas of a) Regulatory agency law, land use, and\nlitigation, including Clean Water Act and stormwater compliance issues; b) Election law,\nincluding ballot measures; and c) Municipal Governance, including insurance coverage,\nreal estate transactions, complex contracts, bankruptcy, Brown Act, and the Public\nRecords Act. Under the Agreement, Law Firm currently represents the City in the defense\nof a Proposition 218 challenge and provides advice and counsel on tax measures and\nProposition 218 issues.\nCommittee Actions Taken: N/A\nOffice of the City Attorney: Jim McNeill, (619) 236-6220
