8G. Approval of Design and Plans and Authorization to Advertise for Construction\nof the Wiro Park Improvements Project (CP23D). Environmental\nConsiderations: This project has been determined to be exempt from the\nCalifornia Environmental Quality Act (CEQA) pursuant to CEQA Guidelines\nSections 15301 and 15302. The project is exempt from environmental review\nper CEQA pursuant to State CEQA Guidelines Section 15301 - Existing\nFacilities, which is a Class 1 exemption. Class 1 exemptions, "consist of the\noperation, repair, maintenance, permitting, leasing, licensing, or minor\nalteration of existing public or private structures, facilities, mechanical\nequipment, or topographic features, involving negligible or no expansion of\nexisting or former use." The proposed scope of work includes the removal and\nreplacement of existing playground equipment, safety surfacing and drainage\nimprovements for the existing community park. This work is expected to take\nplace within the general vicinity of the existing playground and would involve\nnegligible expansion of the existing use of the facility and would not affect the\nuse or function of the existing park. The project is exempt from environmental\nreview per CEQA pursuant to State CEQA Guidelines Section 15302 -\nReplacement or Reconstruction, which is a Class 2 exemption. Class 2\nexemptions, "consist of replacement or reconstruction of existing structures\nand facilities where the new structure will be located on the same site as the\nstructure replaced and will have substantially the same purpose and capacity\nas the structure replaced." Furthermore, within State CEQA Guidelines\nSection 15302, CEQA Guidelines Section 15302(b) would apply, for the\n"replacement of a commercial structure with a new structure of substantially\nthe same size, purpose and capacity." This exempts the replacement of\ncommercial structures with new structures of substantially the same size,\npurpose, and capacity for environmental review.
