(1)\n26-0072\nCD 14\nPUBLIC ANNOUNCEMENT OF BALLOT TABULATION and\nORDINANCE FIRST CONSIDERATION relative to establishment of\nthe Downtown Industrial Business Improvement District (District),\npursuant to Section 53753 of the California Government Code, Section\n36600 et seq. of the California Streets and Highways Code and Article\nXIII D of the California Constitution.\nRecommendations for Council action, if the tabulation of ballots\nindicates majority support, SUBJECT TO THE APPROVAL OF THE\nMAYOR:\n1. PRESENT and ADOPT the accompanying ORDINANCE, dated\nApril 23, 2026, establishing the District and confirming the\nassessments to be levied upon properties within the District, as\ndescribed in the Management District Plan.\n2. AUTHORIZE the City Clerk, subject to approval of the City\nAttorney, to prepare, execute and administer an operating\nagreement between the City and a non-profit corporation for the\nadministration of the District’s programs.\nFiscal Impact Statement: The City Clerk reports that direct costs\nassociated with Department administrative expenses will be charged\nto the District and will be recovered from assessments collected.\nAssessment levied on the City-owned properties within the District to\nbe paid from the General Fund total $16,929.76 for the first year of\nthe District. Funding is available in the Business Improvement District\nTrust Fund 659 to pay the General Fund share of the assessment for\nthe first operating year.\nProposition 218 requires the separation of general benefits from the\nspecial benefits. The general benefit portion for the Downtown\nIndustrial Business Improvement District is $128,636.60 for the first\nyear. However, funds other than assessment revenue must be\nbudgeted annually for the general benefit expense for the remaining\nyears of the District’s seven-year term.
