(26)\n12-1824-S3\nPUBLIC SAFETY and PLANNING AND LAND USE MANAGEMENT\nCOMMITTEES’ REPORT relative to options for increasing fines and\npenalties for repeat “party house” violations.\nRecommendation for Council action, pursuant to Motion (Yaroslavsky\n– Park, Raman, Blumenfield):\nINSTRUCT the City Administrative Officer (CAO), with the assistance\nof the City Attorney, Los Angeles Police Department (LAPD),\nDepartment of Building and Safety (LADBS), Office of Finance, and\nDepartment of City Planning, to report on options for increasing fines\nand penalties for repeat “party house” violations, including, but not\nlimited to:\na. Establishing an updated fine structure and formula that\naccounts for the assessed market value of the subject property,\nthe scale and impact of the violation, the commercial nature of\nthe violation, land use designation, geographic location, and the\ncumulative number of violations.\nb. Establishing penalties that eliminate the hosting capacity of the\nsubject property, including coordination with the Department of\nWater and Power to disconnect or restrict service, and action by\nLADBS to secure the property, where there is evidence of\nchronic, unpermitted commercial use in a residential zone.\nc. Establishing a process for investigating and making an\nadministrative determination of whether a subject residential\nproperty is being used for a revenue-generating purpose.\nd. Implementing a cost recovery mechanism to recoup all costs\nassociated with City intervention, including LAPD and LADBS\novertime, and ensuring effective enforcement of collection\nthrough mechanisms such as a lien on the property.\nFiscal Impact Statement: Neither the CAO nor the CLA has completed\na financial analysis of this report.
