8B. PUBLIC HEARING TO CONSIDER THE INTRODUCTION (FIRST READING)\nOF ORDINANCE NO. 1808 TO AMEND VARIOUS PORTIONS OF SAN\nCLEMENTE MUNICIPAL CODE TITLE 17 - ZONING ORDINANCE, FOR\nCLARITY AND CONSISTENCY, AND FINDING THE ORDINANCE EXEMPT\nFROM THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL\nQUALITY ACT\nPublic hearing to consider amendments to the City of San Clemente\nMunicipal Code Title 17. This includes, but is not limited to: clarifying the\nminimum building setback for patio covers; adding landscape exceptions\nto accommodate Orange County Fire Authority requirements related to\nfuel modification or fire safety in general; reconciling unintended 2014\nGeneral Plan change of land use designation of NC2 to NC1.2; adding a\nminimum setback between a retaining wall and another fence or wall;\nclarifying distinctions between similar sign types and adding specific\nregulations; adding a definition for “vertical landscaping”; and revising the\ndefinition for “wind-driven sign”.\nThe City Council will also consider whether the zoning amendments are\nnot a “project” as defined by the California Environmental Quality Act\n(CEQA) Guidelines Sections 15378(b)(2) and 15378(b)(5), because the\nrevisions relate to the ongoing administrative or discretionary activities\nand organizational or administrative activities of governments that will not\nresult in direct or indirect physical changes in the environment, and\ntherefore do not constitute a “project” as defined by the State CEQA\nGuidelines (Cal. Code Regs., title 14, § 15000 et seq.).\nRecommended Action\n1. Opening the public hearing to receive and consider public comment, and\nclose the public hearing following the public portion of the hearing.\n2. Introduce, and conduct a first reading of Ordinance No. 1808 entitled AN\nORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE,\nCALIFORNIA, APPROVING ZONING AMENDMENT 26-062 AMENDING\nTITLE 17 - ZONING OF THE SAN CLEMENTE MUNICIPAL CODE FOR\nCLARITY AND CONSISTENCY; AND FINDING THIS ACTION EXEMPT\nFROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)\nUNDER STATE CEQA GUIDELINES SECTIONS 15378(B)(2) AND\n15378(B)(5).
