K.\nConsideration of Award of Public Works Agreement to Pacific\nHydrotech Construction; Authorization to Enter Into a New\nOrange County Water District Producer Well Construction Loan\nAgreement, and Approval for Budget Amendment BA #26-11-02\nfor the Lampson Well Treatment System Project, CIP WT1902 -\nThat the City Council adopt Resolution 7777: 1. Approving the\nplans, specifications, and contract documents for the Lampson Well\nTreatment System Project, CIP WT1902; and, 2. Sustaining the bid\nprotest of Pacific Hydrotech Corporation (Pac Hydro), and rejecting\nthe bid of apparent low bidder, RE Chaffee Construction, Inc.\n(Chaffee), as non-responsive and non-responsible; and, 3. Awarding\na Public Works Agreement with Pac Hydro for the Project in the not-\nto-exceed amount of $6,677,200 and waiving minor bid irregularities\nin the bid, and rejecting all other bids; and, 4. Authorizing the City\nManager to execute the Public Works Agreement with Pac Hydro for\nthe Project; and authorizing the City Manager to approve additional\nwork requests and construction support/testing/inspection services\nup to $670,000 (approximately 10%), in connection with the Project;\nand, 5. Authorizing the City Manager to approve off-site inspection\nservices for work within the public right-of-way up to $30,000, in\nconnection with the Project; and, 6. Approving and Authorizing the\nCity Manager, or his designee, to negotiate a new Orange County\nWater District Producer Well Construction Loan Agreement up to a\nloan amount of $8,100,000; and, 7. Authorizing the City Manager, or\nhis designee, to accept and expend the Orange County Water\nDistrict Producer Well Construction Loan Agreement amount; and,\n8. Authorizing a Budget Amendment up to $3,650,000, to reflect the\nnew Orange County Water District Producer Well Construction Loan\nAgreement amount to be negotiated by City Manager, or designee,\nfor CIP WT1902.
