20.\nCONSIDERATION OF AN ORDINANCE ADDING SECTION 3.12.180 (TWO YEAR\nBUDGETS) AND AMENDING SECTIONS 2.24.020(C), 2.28.020(C), 2.32.030(A),\n2.34.020(C), 9.12.030 AND 19.01.010(SEC. 102)(G) OF THE ALHAMBRA MUNICIPAL\nCODE PERTAINING TO THE QUALIFICATIONS FOR MEMBERS OF THE PLANNING\nCOMMISSION, PARKS & RECREATION COMMISSION, LIBRARY BOARD AND\nTRANSPORTATION COMMISSION AS WELL AS DAYTIME LOITERING AND THE\nSALE OF SAFE AND SANE FIREWORKS – F2M26-16, O2M26-4862\nThe Alhambra Municipal Code (“AMC”) is a comprehensive gathering of ordinances\nadopted by the City Council covering a wide range of topics. From time-to-time updates\nare made to the AMC to address new state legislation, clarify ambiguous provisions, or\ndelete outdated language. While some of these changes require immediate consideration\nby the Council, most can be addressed periodically. For this annual review, City staff is\nsuggesting minor changes to the AMC to reflect current practices and clarify confusing\nparts of the AMC. First, City staff identified the proposed addition of Section 3.12.180 (Two\nYear Budget) which would allow for the preparation of two-year budgets, which has been\nstaff’s and the Council’s recent practice and preference to better stabilize the City’s\nfinances. Staff also identified proposed amendments to Sections 2.24.020, 2.28.020,\n2.32.030, 2.34.020 (Qualifications – Parks & Recreation Commission, Board of Library\nTrustees and Transportation Commission) which would further clarify the residency\nrequirements for members of those Boards/Commissions. Furthermore, staff is proposing\namendments to Section 9.12.030 (Loitering; Daytime) which would change the truancy\nhours from 8:30 a.m. to 1:30 p.m. daily to instead refer to “school hours,” given the\nvariation in school hours on a daily basis, and by school. A minor stopped for a potential\nviolation would only be cited if the particular school they attend was in session at that time\nand the minor was not excused from attendance. Finally, staff is proposing an amendment\nto Section 19.01.010 (Sale of Safe and Sane Fireworks) to address an inconsistency\nbetween the fee amount currently stated in the City’s adopted ordinance as it pertains to\nthe sales of Safe and Sane fireworks and the City’s adopted Master Fee Schedule. To\nensure accuracy and flexibility moving forward, the proposed ordinance would remove the\nspecific fee amount and instead direct the public to the City’s current fee schedule, as\nadopted and periodically updated by resolution of the City Council.\nRecommended Action:\nCity Council declare introduced for its first reading the\nfollowing ordinance entitled:\nOrdinance No. O2M26-4862: An Ordinance of the City Council of the City of\nAlhambra, California, adding Section 3.12.180 (Two Year Budgets) and\namending Sections 2.24.020(C), 2.28.020(C), 2.32.030(A), 2.34.020(C),\n9.12.030 and 19.01.010(Sec. 102)(G) of the Alhambra Municipal Code\npertaining to the qualifications for members of the Planning Commission, Parks\n& Recreation Commission, Library Board and Transportation Commission as\nwell as Daytime Loitering and the Sale of Safe and Sane Fireworks\nwhich ordinance will return for a second reading and adoption at the next regular Council\nmeeting.
