22.52.020; CHAPTERS 5.38, 5.52, 5.90, 5.92, AND 22.12; AND ADDING CHAPTER\n22.30 OF THE ALHAMBRA MUNICIPAL CODE – F2M26-16, O2M26-4864\nPeriodically amendments are needed to the Alhambra Municipal Code (“AMC”) based\nupon changes in legislation and issues arising in implementation of the AMC. This\nordinance contains updates to the AMC related to Community Development that are not\ncontained within the Alhambra Zoning Code (“Zoning Code”). A similar clean-up ordinance\namending the Zoning Code is also being considered by the City Council at their meeting\non May 11, 2026. The proposed ordinance, which shows the proposed AMC text changes\nin strikethrough and underline, is provided as an attachment to the May 11, 2026 staff\nreport by the Director of Community Development. The City reviewed the environmental\nimpacts of this Ordinance under the California Environmental Quality Act (Public\nResources Code §§ 21000, et seq. "CEQA”) and the regulations promulgated thereunder\n(14 Cal. Code of Regs. §§ 15000, et seq., the "CEQA Guidelines”). This Ordinance is not\nsubject to further review environmental review because: (1) it will not result in a direct or\nreasonably foreseeable indirect physical change in the environment (14 Cal. Code Regs.\n§ 15060(c)(2); (2) there is no possibility that this Ordinance will have a significant effect\non the environment (14 Cal. Code Regs. § 15061(b)(3)); and (3) the Ordinance, by itself,\ndoes not constitute a “project” as defined in section 21065 of the Public Resources Code\nand the CEQA Guidelines (14 Cal. Code Regs. § 15378). It can be seen with certainty that\nthere is no possibility that this Ordinance may have a significant effect on the environment.\nRecommended Action:\nCity Council:\n1.\nDirect the City Attorney to introduce and give first reading by title only, waiving\nfurther reading to the following ordinance entitled:\nOrdinance No. O2M26-4864: An Ordinance of the Alhambra City Council amending\nSections 6.36.030, 20.23.030, 22.08.060, 22.20.090, 22.24.080, and 22.52.020, and\nChapters 5.38, 5.52, 5.90, 5.92, and 22.12, and adding Chapter 22.30 to the Alhambra\nMunicipal Code and finding such actions exempt from further environmental review\nunder CEQA Guidelines Sections 15060(C)(2), 15061(B)(3), and 15378\nwhich ordinance shall return for a second reading and adoption at the next City\nCouncil meeting on June 22, 2026;\n2.\nDetermine this action is exempt from CEQA.\n22.\nSECOND READING AND ADOPTION OF AN ORDINANCE ADDING CHAPTER 6.29\n(“RESIDENTIAL TENANT PROTECTIONS”) TO TITLE VI (HEALTH AND\nSANITATION) OF THE ALHAMBRA MUNICIPAL CODE ESTABLISHING AN\nINCREASED RELOCATION ASSISTANCE OBLIGATION ON CERTAIN NO-FAULT\nRESIDENTIAL EVICTIONS IN THE CITY OF ALHAMBRA – F2M26-7, O2M26-4861\nStaff is requesting that the City Council consider second reading and adoption of an\nordinance adding Chapter 6.29 (Residential Tenant Protections) To Title VI (Health and\nSanitation) of the Alhambra Municipal Code establishing an increased relocation\nassistance obligation on certain no-fault residential evictions in the City of Alhambra. On\nApril 13, 2026, the City Council directed staff to prepare an ordinance to increase\nrelocation assistance payments for no-fault evictions from one (1) month to three (3)\nmonths’ rent. The proposed ordinance would add Chapter 6.29 to the City’s Municipal\nCode, requiring that in those circumstances where relocation assistance is required under\nAB 1482, that the obligation would be increased from one to three months. To the extent\nthat an owner/landlord does not comply with this requirement, the ordinance provides that\nsuch noncompliance can be asserted as a defense in any action brought by the owner to\nrecover possession of a residential unit. Under AB 1482, landlords are required to provide\nrelocation assistance for certain no-fault evictions, including owner move-in, substantial\nrehabilitation, demolition, or withdrawal of units from the rental market. The proposed\nordinance was given first reading at the April 27, 2026 City Council meeting.\nRecommended Action:\nCity Council declare introduced for its second reading and\nadopt the following ordinance entitled:\nOrdinance No. O2M26-4861: An Ordinance of the City Council of the City of\nAlhambra, California adding Chapter 6.29 (“Residential Tenant Protections”)\nto Title VI (Health and Sanitation) of the Alhambra Municipal Code establishing\nan increased relocation assistance obligation on certain no-fault residential\nevictions in the City of Alhambra
