10G. Adoption of Resolution of Intention No. 2026-19 and Introduction of\nOrdinance No. 2026-06 to amend the City of Encinitas’ contract with the\nCalifornia Public Employees’ Retirement System to change the retirement\nclassification of the Fire Marshal positions from Local Miscellaneous to Fire\nSafety. Environmental Considerations: The action being considered by the\nCity Council is exempt from the California Environmental Quality Act (CEQA)\nbecause it is not a "project" under Section 15061(b)(3) of the CEQA\nGuidelines because it can be seen with certainty that there is no possibility\nthat the activity in question may have a significant effect on the environment.\nThe action is also exempt from CEQA under Section 15378(b)(5) of the CEQA\nGuidelines because it involves an organizational or administrative activity of\ngovernment that will not result in the direct or indirect physical change in the environment. Contact Person: Human Resources Manager Wecker\nRecommended Action: 1) Adopt Resolution of Intention No. 2026-19 titled,\n"Resolution No. 2026-19 Resolution of Intention to Approve an Amendment to\nContract Between the Board of Administration California Public Employees\nRetirement System and the City Council City of Encinitas"; 2) Introduce\nOrdinance No. 2026-06, titled "An Ordinance of the City Council of the City of\nEncinitas, California, Authorizing an Amendment to the Contract Between the\nCity Council of the City of Encinitas and the Board of Administration of the\nCalifornia Public Employees' Retirement System"; and 3) Adopt the Side\nLetter Agreement to the Memorandum of Understanding 2023 - 2027 between\nthe City of Encinitas and the Service Employees International Union (SEIU),\nLocal 221 regarding Retirement contributions for Fire Marshal positions.
