Amendment No. One to Encroachment and Landscape Maintenance\nAgreement Between the City of Newport Beach and the Balboa Island\nImprovement Association EPN2010-0097\na) Find this project categorically exempt from the California Environmental Quality\nAct (CEQA) pursuant to Section 15311(a) (Accessory Structures) of the CEQA\nGuidelines, California Code of Regulations, Title 14, Chapter 3, because the project\nconsists of placement of minor accessory public improvements involving negligible\nor no expansion of existing use; and\nb) Approve Amendment No. One to the Encroachment and Landscape\nMaintenance Agreement Between the City of Newport Beach and Balboa Island\nImprovement Association (EPN2010-0097) and authorize the Mayor and City Clerk\nto execute the agreement; and\nc) Waive City Council Policies B-17 (Parks, Facilities and Recreation Program\nDonations) and L-6 (Encroachments in Public Rights-of-Way) to allow for the\ncommemorative donation plaque and use of 110 voltage electrical wiring for\nuplighting of the flagpole within the public right-of-way.\nStaff Report\nAttachment A - Encroachment and Landscape Maintenance Agreement\nAttachment B - Amendment No. One to Agreement
