6.A. ORDINANCE APPROVING DEVELOPMENT AGREEMENT (DA-25-1), RESOLUTION APPROVING VARIANCE (V-25-1), PURCHASE AND SALE AGREEMENT, OWNER PARTICIPATION AGREEMENT, AND RECIPROCAL EASEMENT AND MAINTENANCE AGREEMENT TO ALLOW THE DEVELOPMENT OF AN AQUARIUM, BUTTERFLY CONSERVATORY AND ASSOCIATED IMPROVEMENTS AT 7711-7733 BEACH BOULEVARD Presented by Matt Foulkes, Director of Community and Economic Development — Recommended Action: It is recommended that the City Council conduct a public hearing and after considering evidence presented take the following actions: 1) Adopt an Ordinance approving Development Agreement (DA-25-1), and find that the project is exempt from CEQA pursuant to Public Resources Code section 21083.3 and CEQA Guidelines Section 15183; 2) Adopt a Resolution approving Variance (V-25-1); 3) Approve an Agreement for the Purchase, Sale, and Development of Real Property (PSA), Owner Participation Agreement (OPA) and Reciprocal Easement and Maintenance Agreement for the sale, development, continued operation of an entertainment development comprised of an aquarium, a butterfly conservatory, ancillary retail uses, and associated on- and off-site improvements for the City-owned property located at 7711- 7733 Beach Boulevard; and 4) Authorize the City Manager and City Attorney to make any reasonable, non- monetary changes to the agreements necessary to effectuate the transaction; and, 5) Authorize the City Manager and City Clerk to execute the transaction agreements on behalf of the City.
