(13) 25-0916 CD 15 COMMUNICATION FROM THE DEPARTMENT OF CITY PLANNING (DCP) and RESOLUTION (MCOSKER – BLUMENFIELD) relative to an extension of an Interim Control Ordinance that temporarily prohibits the processing of any by-right land use permits for "Smoke & Vape Shop" uses and/or the issuance of any tobacco retailer permits for these uses within the geographical boundaries of Council District 15. A. COMMUNICATION FROM THE DCP Recommendation for Council action: ADOPT the DCP report dated July 24, 2026, attached to the Council file, as its own recommending an extension of the Smoke & Vape Shop Interim Control Ordinance (Ordinance No. 188977). B. RESOLUTION (MCOSKER – BLUMENFIELD) Recommendation for Council action: RESOLVE that by the adoption of this Resolution, the Council hereby extends the provisions of Ordinance No. 188977 for a period of 10 months and 15 days, thereby continuing the temporary prohibition on the processing of any by-right land use permits for Smoke and Vape Shop uses and the issuance of any related tobacco retailer permits for these uses within the geographical boundaries of Council District 15, inasmuch as the appropriate City agencies and officials are exercising due diligence and actively working towards the adoption of the appropriate permanent land use regulatory controls. Fiscal Impact Statement: None submitted by the DCP. Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.
