2.1 RESOLUTION APPROVING VACATION OF A PORTION OF LAKEVIEW DRIVE AND\nSPRUCE ROAD RIGHT-OF-WAY AND FINDING THE ACTION CATEGORICALLY EXEMPT\nFROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nCity Council will conduct a public hearing and will consider a formal resolution to vacate a portion of\nLakeview Drive and Spruce Road which would abandon an approximately 1,000 square foot section of\nLakeview Drive and Spruce Road. Private improvements supporting the former Cowboy Express\nSteakhouse, addressed at 40433 Lakeview Drive have been constructed in this portion of the right-of-way,\nincluding parking spaces, and a retaining wall. On February 2, 2023, the Planning Commission determined\nthat the request is consistent with the General Plan. At a regular meeting on March 8, 2023, City Council\ntook action to set the public hearing and also declared the action exempt from the Surplus Lands Act.\nEnvironmental Determination: Under Section 15061(b)(3) of the CEQA Guidelines, this is exempt under\nthe “common sense exemption” and, therefore, no environmental review is required.
