10.12 1) Approval of Purchase and Sale Agreement with Black Diamond 218 - 240\nPools and Design for property located at the north/west corner of\nSmurr Street and Wilson Avenue (Assessor Parcel Number 611-222-\n015) in the not to exceed the amount of $530,000 plus title and\nescrow costs and other related expenses not to exceed $15,000, and\nfinding conformity with the General Plan and determining that the\nproject qualifies for the common sense exemption pursuant to\nSection 15061 (b)(3) as it can be seen with certainty that there is no\npossibility that the activity in question may have a significant effect\non the environment and that any future development of the subject\nproperties will be required to be in conformance with the Program\nFinal Environmental Impact Report (PFEIR) for the Downtown\nSpecific Plan certified by the Indio City Council on April 15, 2020;\nand 2) Authorize the City Manager to execute all documents\nnecessary to complete the sale (Carl S.
