1. Recommendation to introduce Ordinance No. 2023­611, repealing and replacing\nChapter 5.30 to Title 5 of the Hawaiian Gardens Municipal Code, imposing\nregulations on sidewalk vending in compliance with Senate Bill 946 and 972;\nDeclare that the Ordinance is exempt from the California Environmental Quality Act\n(“CEQA”) pursuant to State CEQA Guidelines, as it is not a “project” and has no\npotential to result in a direct or reasonably foreseeable indirect physical change to\nthe environment. 14 Cal. Code Regs. § 15378(a). Further, this Ordinance is exempt\nfrom CEQA as there is no possibility that this Ordinance or its implementation would\nhave a significant negative effect on the environment. 14 Cal. Code Regs. §\n15061(b)(3); and\nSet Ordinance No. 2023­611 for adoption at the July 11, 2023 City Council meeting.\nSUGGESTED ACTION: Approve Recommendation.
