10. AWARD CONTRACT: MAIN STREET, FOURTH STREET, AND MISSION ROAD\nSEWER MAIN REPLACEMENT PROJECT - PHASE 1 – F2M22-53, N2M23-31, C2M23-\n48, M2M23-98\nOn March 13, 2023, the City Council approved the distribution of Notice Inviting Bids for\nthe Main Street, 4th Street, and Mission Road Sewer Main Replacement Project – Phase\n1. On April 13, 2023, the City received and opened five (5) bids for the Project. CEM\nConstruction Corp. submitted the lowest bid. However, during the bid evaluation process\nit was discovered that CEM Construction Corp. did not perform similar work in the past,\nas required per the Notice Inviting Bids. Therefore, the bid from CEM Construction Corp.\nwas deemed non-responsive. The second lower bidder, Toro Enterprises, Inc., was\ndeemed the lowest responsive bidder. Staff reviewed the bid submitted by Toro\nEnterprises, Inc. and found it to be in full compliance and conformance with the project\nspecifications.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, by and between the City of Alhambra and\nToro Enterprises, for the Main Street, 4th Street, and Mission Road Sewer Main\nReplacement Project - Phase 1 in an amount not to exceed $3,515,580.00; find the Project\ncategorically exempt from California Environmental Quality Act (CEQA) pursuant to CEQA\nGuidelines Section 15301 (b); and, direct staff to undertake the steps necessary to finalize\nCouncil’s action.
