4-B. A CONTINUED PUBLIC HEARING TO CONSIDER ADOPTING A RESOLUTION\nESTABLISHING CITY-WIDE FEES RELATED TO THE INCLUSIONARY HOUSING\nORDINANCE\nIt is recommended that the City Council consider:\n(1)\n(2) Adopting a resolution establishing the formula to calculate in-lieu fees and fees associated\nwith the calculation of in-lieu fees for the Inclusionary Housing Ordinance; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nPursuant to the California Environmental Quality Act (Public Resources Code § 21000, et seq.;\n“CEQA”) and its implementing regulations (14 Cal. Code of Regs. § 15000, et seq.; the "CEQA\nGuidelines”), the proposed fee resolution is categorically exempt from further CEQA review for\nthe following reasons: (1) they will not result in a direct or reasonably foreseeable indirect\nphysical change in the environment (CEQA Guidelines § 15060(c)(2)); (2) there is no possibility\nthat the may have a significant effect on the environment because any potential, future, housing\nprojects would undergo separate environmental review (CEQA Guidelines § 15061(b)(3)); and\n(3) the Resolution, by itself, does not constitute a “project” as defined in the CEQA Guidelines\nbecause it involves a policy action that is legislative implementing affordable housing policy and\naffects prospective future housing development to comply with Housing Element Program 15\n(CEQA Guidelines § 15378).
