2. A Public Hearing to Consider Zoning Code Amendment ZCA 23-02\nIntroducing an Ordinance Amending Laguna Niguel Municipal Code Section\n9-1-95 to Establish Multifamily and Mixed-Use Residential Objective\nDevelopment and Design Standards for Projects that Qualify for Streamlined\nMinisterial Review Under State Law; and Determining the Action to be\nExempt from the California Environmental Quality Act Under State CEQA\nGuidelines Section 15061(b)(3)\nRecommendation\nStaff recommends that the City Council open the public hearing, take public\ntestimony, close the public hearing, and then take the following actions:\n1. Find that adoption of the proposed ordinance is exempt from the California\nEnvironmental Quality Act (“CEQA”) because it is an administrative activity\nthat will not result in a direct or reasonably foreseeable indirect physical\nCity Council Regular Meeting Agenda Page 5 of 7 November 7, 2023\nchange to the environment and thus is not a “project” under State CEQA\nGuidelines Section 15378 (see State CEQA Guidelines, § 15060(c)(2) and\n(3)). Alternatively, even if adoption of the ordinance did qualify as a project\nunder CEQA, find that it is exempt from CEQA pursuant to Section\n15061(b)(3) of the State CEQA Guidelines, which provides that a project is\nexempt from CEQA where it can be seen with certainty that there is no\npossibility that the activity in question may have a significant effect on the\nenvironment.\n2. Waive full reading, make any amendments to, and introduce Ordinance No.\n2023-225 by title:\nORDINANCE NO. 2023-225\nAN ORDINANCE OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,\nADOPTING ZONING CODE AMENDMENT ZCA 23-02 AMENDING LAGUNA\nNIGUEL MUNICIPAL CODE SECTION 9-1-95 TO ESTABLISH\nMULTIFAMILY AND MIXED-USE RESIDENTIAL OBJECTIVE\nDEVELOPMENT AND DESIGN STANDARDS FOR PROJECTS THAT\nQUALIFY FOR STREAMLINED MINISTERIAL REVIEW UNDER STATE\nLAW, AND DETERMINING THE ACTION TO BE EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER STATE\nCEQA GUIDELINES SECTION 15061(B)(3)\n3. Direct that the proposed ordinance, with any changes, be placed on the\nagenda for the December 5, 2023, City Council Meeting and adopt the\nordinance at that meeting.\nCITY COUNCIL\n1.
