10A. City Council to consider and direct staff to initiate an ordinance implementing\nnew legislation that went into effect on January 1, 2023, pursuant to Assembly\nBill (AB) 2097. Environmental Considerations: The action before the City\nCouncil is not subject to the California Environmental Quality Act (CEQA)\n11/11/23, 10:24 PM encinitas.granicus.com/GeneratedAgendaViewer.php?view_id=7&event_id=3956\npursuant to Section 15060(c)(3) of the CEQA Guidelines since the action is\nnot a "project" pursuant to Section 15378(b)(5). The action involves an\norganizational or administrative activity of government that will not result in a\ndirect or indirect physical change in the environment. Environmental review\nwill be conducted in connection with and prior to the adoption of any resulting\nordinances. Contact Person: Associate Planner Cvetko\nRecommended Action: 1) City Council to provide specific direction on key\nprovisions to include in the ordinance and provide feedback; and 2) Adopt\nResolution No. 2023-107, titled "A Resolution of the City Council of the City of\nEncinitas, California, directing staff to initiate amendments to the Municipal\nCode, the Downtown Encinitas, North 101 Corridor, and Encinitas Ranch\nSpecific Plans, and the Local Coastal Program to implement State Law AB\n2097 prohibiting minimum automobile parking requirements on residential,\ncommercial, and other development projects within one-half mile of public\ntransit."\n2023-11-15 Item 10A AB 2097
