63. Department of Public Social Services Lease Agreement\nRecommendation: Authorize the Chief Executive Officer to execute a proposed\n15-year lease with Omninet Freeway LP, a Delaware limited partnership\n(Landlord), for the Department of Public Social Services’ (DPSS) use of\napproximately 207,289 sq ft of office space and 915 on-site parking spaces\nlocated at 1500 Hughes Way in Long Beach (Premises) (4), with an estimated\nmaximum first-year base rental amount of $7,213,657, with a one-time rent\nconcession of $249,461 at inception of the proposed lease, which will equal\n$6,964,196, the estimated total proposed lease amount, including Tenant\nImprovement (TI) costs, and low-voltage, is $166,659,000 over the 15-year\nterm, with rental costs to be funded by 80.11% State and Federal funds and\n19.89% by Net County Cost that is already included in DPSS’ existing budget;\nfind that the proposed lease is exempt from the California Environmental Quality\nAct (CEQA); find that the issuance of taxable commercial paper notes (Notes)\nthrough the County Capital Asset Leasing Corporation Lease Revenue Note\nProgram (Note Program) to finance TI costs at the Premises is not subject to\nCEQA; and take the following actions: (Chief Executive Office)\nAuthorize the Chief Executive Officer to reimburse the Landlord up to\n$23,838,235 for the County’s TI contribution, to be paid in lump sum;\nTo finance the County’s TI contribution, establish TI Project No. 57333\nfor the proposed lease at the Premises;\nAuthorize the issuance of Notes through the Note Program in an amount\nnot to exceed $23,838,235 for the TI costs;\nAuthorize the Director of Public Social Services to contract with, and\ninstruct the Director of Internal Services, in coordination with the Chief\nExecutive Officer, for the acquisition and installation of telephone, data,\nand low-voltage systems and vendor installation (Low-Voltage Items) at a\ntotal amount not to exceed $15,105,756 if paid in a lump sum, or\n$17,182,884 if amortized over five years at 8% interest per annum, with\nthe cost for the Low-Voltage Items to be in addition to the rental costs\nand the County’s TI contribution payable to the Landlord; and\nAuthorize the Chief Executive Officer to execute any other ancillary\ndocumentation necessary to effectuate the terms of the proposed lease,\nand take actions necessary and appropriate to implement the terms of\nthe proposed lease including, without limitation, exercising any early\ntermination rights.
