2. Moving Forward with Recommendations and Restrictions on Alcohol\nConsumption in the Sheriff’s Department’s Safety of Firearms Policy\nRecommendation as submitted by Supervisors Solis and Horvath: Request the\nSheriff, and instruct the Inspector General, to work in collaboration to adopt\nrevisions designed to improve the Sheriff’s Department’s Firearm Safety policy\nand reduce the risk of negative outcomes involving the dangerous mix of alcohol\nand firearms; request that the Sheriff revise the Safety of Firearms policy to\nremove the rebuttable presumption language, revise the Safety of Firearms\npolicy to include a strict prohibition against carrying firearms while consuming\nalcohol, on or off-duty, revise the Safety of Firearms policy to add language\nsimilar to MPP 3-01/090.10 indicating that “if a member has an odor of\nalcoholic beverage or there is a reasonable suspicion to believe [the] member is\nunder the influence of alcohol the unit commander or higher shall order test of\nthe member. If the member refuses any order to be tested the member shall be\nsubject to discipline;” and revise the Safety of Firearms policy to mandate\nalcohol testing for all off-duty accidental discharges; and take the following\nactions:\nInstruct County Counsel and the Inspector General, in collaboration with\nthe Sheriff, to also include policies to clearly restrict the use of or being\nunder any influence of alcohol when on-duty;\nRequest the Sheriff to report back to the Board in writing within 90 days\nregarding whether they have agreed to adopt any of the requests\ncontained in the above directive, and if not, why they are choosing not to\nadopt any such recommendations; and\nRequest the Sheriff to report back to the Board in writing within 90 days\nregarding the Sheriff’s Department’s policies designed to provide the\nsame, or similar, guidance related to other legal, or illegal, substances\nthat may lead to intoxication or impaired judgment, including marijuana,\nprescription medication and other drugs.
