25. 24-51936 Recommendation to receive supporting documentation into the record, conclude\nthe public hearing and consider a third-party appeal from Lozeau Drury LLP, on\nbehalf of Supporters Alliance for Environmental Responsibility (SAFER) (APL23-\n018);\nAdopt resolution determining that the project is consistent with and within the\nscope of the project previously analyzed as part of the Downtown Plan Program\n(PD-30) Environmental Impact Report (PEIR) (EIR-04-08) (SCH No. 2009071006)\nand Downtown Plan Program EIR Land Use Equivalency Program and PEIR\nAddendum (EIRA-06-20) (PECC-06-22) and subject to the Downtown Plan\nMitigation Monitoring and Reporting Program and making certain findings and\ndeterminations related thereto and warrants no further environmental review\npursuant to the California Environmental Quality Act (CEQA) Guidelines Section\n15162 and 15168; and\nDeny the appeal and uphold the decision of the Planning Commission to approve\nthe Site Plan Review (SPR22-135), and adopt the proposed findings and\nconditions of approval related thereto, for a project consisting of the demolition of\nan existing three-story hotel building and the construction of a new eight-story\nmulti-family residential building consisting of 141 dwelling units (16 of which are\naffordable [very-low income]) in a building with 75 vehicular parking spaces in an\nat-grade and subterranean parking structure, 54 bicycle parking spaces, 3,125\nsquare feet of common open space and 2,630 square feet of private open space\narea located at 335 Pacific Avenue in the Downtown Plan (PD-30) Planned\nDevelopment District. The locally designated historic landmark sign (Dolly Varden\nRooftop Sign) would be temporarily removed, preserved, and relocated onto the\nproposed building subject to the final Certificate of Appropriateness conditions\n(COAC2212-02).
