58. County Code, Title 8 - Consumer Protection, Business and Wage\nRegulations Amendment\nOrdinance for adoption amending County Code, Title 8 - Consumer Protection,\nBusiness and Wage Regulations, by establishing new and updated public health\npermit, plan check, and service fees related to requirements for compact mobile\nfood operations, mobile food facilities and commissaries, to align with recent\nchanges to the California Retail Food Code pursuant to Senate Bill 972, these\namendments establish health and safety standards for certain retail food\nfacilities and allow the Department of Public Health to perform services that are\nprimarily offset by fees from the permits and services provided, with the\namendments to implement the following: ADOPT\nDefines and establishes what a "compact mobile food operation" (CMFO)\nis and also provides for the requirements needed in order to meet certain\nstandards;\nAllows for CMFOs to offer prepackaged food or limited food preparation;\nProvides the enforcement agency the authority to approve permanent\nfood facilities to operate as a CMFO;\nAllows the use of a private home for the storage of a CMFO;\nRequires the local health agency to approve storage of a CMFO in a\npermitted permanent food facility;\nExempts a CMFO that has 25 square feet or less of display area and\nsells only prepackaged, non-potentially hazardous foods or whole\nuncooked produce from the permit requirement;\nAuthorizes the local health agency to preapprove a standard plan for the\nmass production of CMFO, and to collect a fee for the final inspection of\nthe CMFO;\nAuthorizes a cottage food operation to serve as a commissary for up to\ntwo CMFOs if the cottage food operation includes an endorsement from\nthe local health agency; and also, the cottage food operation must be\ncapable of supporting the preparation and storage of the food being sold\nfrom the CMFO and the storage and cleaning of the CMFO;\nAuthorizes approved cottage food items prepared in a permitted cottage\nfood operation to be served from a CMFO; and\nMakes violations of State law and the County Code by an operator or\nemployee of a compact mobile food facility or a sidewalk vendor\npunishable only by an administrative fine.
