10B. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING SECTION 20.400.330 OF THE STANTON MUNICIPAL\nCODE REGARDING ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY\nDWELLING UNITS TO ENSURE CONSISTENCY WITH STATE REGULATIONS AND\nFINDING THE ACTION TO BE EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nIn September 2022, the California Legislature approved, and the Governor signed into\nlaw, a new bill (“SB 897”) that further amends Government Code sections 65852.2 and\n65852.22—the state statutes regulating accessory dwelling units (“ADUs”) and junior\naccessory dwelling units (“JADUs”), respectively. SB 897 went into effect on January 1,\n2023. If the City’s ADU ordinance does not comply with state law, then its entire ADU\nordinance becomes null and void as a matter of law. The attached ordinance updates\nthe City’s ADU ordinance to comply with SB 897.\nRECOMMENDED ACTION:\n1. City Council conduct a public hearing; and\n2. City Council find the proposed project exempt from the California Environmental\nQuality Act (CEQA) under California Public Resources Code Section 21080.17,\nwhich exempts the adoption of an accessory dwelling unit ordinance to implement\nthe provisions of Section 65852.2 of the California Government Code; and\n3. Introduce for first reading Ordinance No. 1127, in accordance with California\nGovernment Code Title 5, Division 1, Part 1, as published by the Building Standards\nBulletin 22-02, entitled:\n“AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING SECTION 20.400.330 OF THE STANTON\nMUNICIPAL CODE REGARDING ACCESSORY DWELLING UNITS AND\nJUNIOR ACCESSORY DWELLING UNITS TO ENSURE CONSISTENCY\nWITH STATE REGULATIONS AND FINDING THE ACTION TO BE EXEMPT\nFROM CEQA”; and\n4. Set said Ordinance No. 1127 for a public hearing and second reading at the regular\nCity Council meeting of February 28, 2023.\nFebruary 14, 2023
