11A. CONSIDERATION OF EXTENSION OF EXPIRED COMMERCIAL CANNABIS\nCULTIVATION PERMITS AND ISSUANCE OF DELIVERY PERMITS FOR EXISTING\nOPERATIONAL COMMERCIAL CANNABIS RETAIL OUTLETS\nAt the December 12, 2023, City Council meeting, after considering a request to extend\nexpired commercial cannabis cultivation permits, the City Council directed staff to\nresearch operational commercial cannabis cultivation businesses in the surrounding\nregion, with a focus on timelines to become operational. In addition, staff is proposing City\nCouncil consideration of the issuance of delivery permits for existing operational\ncommercial cannabis retail outlets.\nRECOMMENDED ACTION:\n1. City Council find that these actions are not subject to California Environmental Quality\nAct (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment) and even if they were considered a project, they would still be\nexempt from CEQA under State CEQA Guidelines Section 15301; and\n2. Authorize an extension of up to 36 months with a selected tiered cultivation tax\npayment schedule for expired commercial cannabis cultivation permits and prepare\nthe necessary supporting Municipal Code amendments; and\n3. Authorize staff to re-open the application period specifically for delivery permits to the\ncurrently operational retail permit holders in good standing and prepare the necessary\nsupporting Municipal Code amendments.
