9.a. DISCUSSION AND POSSIBLE DIRECTION REGARDING OPTIONS\nFOR ADDITIONAL RESTRICTIONS ON SMOKING IN PUBLIC PLACES\nAND THE SALE OF TOBACCO IN THE CITY\nAt the February 13, 2024, City Council meeting, the City Council\nexpressed interest in exploring its options to address smoking and tobacco\nsales in the City following a presentation discussing the same.\nAccordingly, by way of this staff report, the City Attorney’s Office further\nevaluated the matter to provide the City Council some options to address\nthe regulation of smoking and prohibition of the sale of all tobacco\nproducts.\nRECOMMENDED ACTION: (1) Continue to follow and enforce the City’s\ntobacco and electronic cigarette retail permitting regulations and smoking\nprohibitions pursuant to Chapters 8.40 and 8.42 of the South El Monte\nMunicipal Code (“SEMMC”) as it adopts and implements provisions\ndelineated by Federal and State law; and (2) Consider amending the\nSEMMC to ban the sale of flavored tobacco products and tobacco product\nflavor enhancers pursuant to Senate Bill 793.
