PUBLIC SAFETY COMMITTEE REPORT relative to requesting the
City Attorney to report on the feasibility of pursuing proactive civil or
criminal litigation against entities whose conduct may contribute to the
illegal possession, sale, distribution, or use of fireworks within the City
of Los Angeles.
Recommendations for Council action, pursuant to Motion (McOsker -
Lee):
1. REQUEST the City Attorney to report on the feasibility of
pursuing proactive civil or criminal litigation against
manufacturers, importers, shippers, distributors, wholesalers,
traders, retailers, commercial purchasers, or other entities
whose conduct may knowingly or negligently contribute to the
illegal possession, sale, distribution, or use of fireworks within
the City, including potential liability, supply-chain tracing
methods, available remedies and damages, and coordinated
litigation strategies.
2. REQUEST the City Attorney and Chief Legislative Analyst to
report on recommended next steps, including data and
investigative needs, interdepartmental coordination, potential
legislative action or pilot enforcement strategies, barriers to
implementation, and any legislative or administrative changes
needed.
Fiscal Impact Statement: Neither the City Administrative Officer nor
the Chief Legislative Analyst has completed a financial analysis of this
report.
