8G. Approval of Design and Plans and Authorization to Advertise for Construction of the Wiro Park Improvements Project (CP23D). Environmental Considerations: This project has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301 and 15302. The project is exempt from environmental review per CEQA pursuant to State CEQA Guidelines Section 15301 - Existing Facilities, which is a Class 1 exemption. Class 1 exemptions, "consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features, involving negligible or no expansion of existing or former use." The proposed scope of work includes the removal and replacement of existing playground equipment, safety surfacing and drainage improvements for the existing community park. This work is expected to take place within the general vicinity of the existing playground and would involve negligible expansion of the existing use of the facility and would not affect the use or function of the existing park. The project is exempt from environmental review per CEQA pursuant to State CEQA Guidelines Section 15302 - Replacement or Reconstruction, which is a Class 2 exemption. Class 2 exemptions, "consist of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced." Furthermore, within State CEQA Guidelines Section 15302, CEQA Guidelines Section 15302(b) would apply, for the "replacement of a commercial structure with a new structure of substantially the same size, purpose and capacity." This exempts the replacement of commercial structures with new structures of substantially the same size, purpose, and capacity for environmental review. The proposed scope of work includes the removal and replacement of existing playground equipment, safety surfacing and drainage improvements for the existing community park.
