(10) 26-1106 ARTS, PARKS, AND CITY FACILITIES COMMITTEE REPORT relative to declaring the City-owned property adjacent to Loma Verde Avenue (Property) in Council District Three, Assessor Parcel No. (APN) 2112- 001-904, as Exempt Surplus Land. Recommendations for Council action, pursuant to Motion (Blumenfield - Hutt): 1. DECLARE the City-owned Property adjacent to Loma Verde Avenue (APN 2112-001-904) as "Exempt Surplus Land" pursuant to the California Surplus Land Act, inasmuch as the Property qualifies as exempt surplus' land under Government Code Section 54221(f)(1)(B), which exempts, "[s]urplus land that is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open space or low- and moderate-income housing purposes." Notwithstanding Section 54221(f)(2), under Government Code Section 54221(f)(2), the Property cannot qualify as exempt surplus land if it is: a. Within a coastal zone. b. Adjacent to a historical unit of the State Parks System. c. Listed on, or determined by the State Office of Historic Preservation to be eligible for, the National Register of Historic Places. d. Within the Lake Tahoe region as defined in Section 66905.5. Because none of these characteristics apply to this Property, it qualifies as exempt surplus land under the Surplus Land Act. 2. DIRECT the General Services Department, with the assistance of the City Attorney and City Administrative Officer (CAO), to take all necessary steps and prepare all required documents to effectuate the sale of the parcel. Fiscal Impact Statement: Neither the CAO nor the Chief Legislative Analyst has completed a financial analysis of this report.
