14B. Council Initiated Item by Council Member Marco San Antonio SMOKE-FREE LODGING Update Encinitas Municipal Code Chapter 11.08 to Require 100% Smoke-Free Guestrooms in Hotels, Motels, and Other Transient Lodging Establishments Environmental Considerations: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a “project” under Section 15378(b)(5) of CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in the direct or indirect physical change in the environment. Recommended Action: Direct staff to return to the City Council with an ordinance amending Chapter 11.08 of the Encinitas Municipal Code to remove the provision allowing smoking in up to 20 percent of hotel and motel guestrooms. The amendment should bring the City’s code in line with current California law, which requires all guestrooms in transient lodging establishments to be smoke-free. Staff should also ensure that these state and local requirements are clearly communicated and consistently applied to hotels, motels, and other affected businesses in Encinitas. 2026-10-21 Item 14B Council Initiated Item San Antonio Smoke-Free Lodging
