38. East Los Angeles Monument Improvements Project Construction\nContract\nRecommendation: Approve the East Los Angeles Monument Improvements\nProject (Project) (1), and authorize the Director of Public Works to adopt the\nplans and specifications and advertise for bids at an estimated construction\ncontract amount between $900,000 and $1,400,000 for the Project, with\nfunding included in the First Supervisorial District's Transportation\nImprovement Program in the Measure M Local Return Fund Fiscal Year\n2023-24 Budget; find that the proposed Project is exempt from the\nCalifornia Environmental Quality Act; and authorize the Director of Public\nWorks, acting as the Road Commissioner, to take the following actions:\n(Department of Public Works) ADOPT\nAdvertise for bids when ready to advertise the Project;\nOpen and examine bids received at a public meeting called by the\nDirector, and determine whether the bid of the apparent responsible\ncontractor with the lowest apparent responsive bid is, in fact,\nresponsive and, if not responsive, determine which apparent\nresponsible contractor submitted the lowest responsive bid;\nAward and execute a construction contract for the Project with the\nresponsible contractor with the lowest responsive bid within or less\nthan the estimated amount range or that exceeds the estimated\namount range by no more than 15% if additional funds have been\nidentified; and\nExtend the date and time for the receipt of bids, allow substitution of\nsubcontractors and relief of bidders, approve and execute change\norders within the same monetary limits delegated to the Director,\naccept the Project upon its final completion, and release retention\nmoney withheld.
