5.A. FEASIBILITY STUDY FOR THE REPLACEMENT OF ABOVE LOWER\nINCOME PROTECTED UNITS [N. MARICICH, F. CONTRERAS, T.\nFARRIS, M. MONTENEGRO]:\nSUBJECT: The City Council will receive a feasibility study (“Study”)\nanalyzing the replacement requirement of the above lower-income\nprotected units in new housing projects. Additionally, the City Council will\nconsider directing staff to prepare a Zone Text Amendment (ZTA), based\non the findings of the study, to require the replacement of demolished\nrent-stabilized units (protected units) that were also occupied by\nhouseholds or individuals of above lower income (80% or higher Area\nMedian Income) account for 32 percent (32%) of the base units in a\nproposed housing development as deed-restricted affordable units, with\nany remainder subject to rent stabilization (WHMC Title 17).\nRECOMMENDATIONS: 1) Receive and file the Feasibility Study for the\nReplacement of Above Lower-Income Protected Units; and 2) Direct staff\nto process a ZTA to require the replacement of demolished rent-stabilized\nunits that were also occupied by households or individuals of above lower\nincome (80% or higher Area Median Income) account for 32 percent\n(32%) of the base units in a proposed housing development as deed-\nrestricted affordable units, with any remainder subject to rent stabilization\n(WHMC Title 17).
