48. Specialty Mental Health Services Legal Entity Contract Amendments\nRecommendation: Approve and authorize the Director of Mental Health to\nexecute an amendment to the existing Department of Mental Health (DMH) Legal\nEntity (LE) contracts, for the continued provision of Specialty Mental Health\nServices (SMHS), to extend the term of the contracts for two Fiscal Years (FYs)\nending June 30, 2026, with one optional extension year, for a total aggregate\namount for FYs 2024-25 and 2025-26 of $1,542,507,585 per fiscal year,\nfunded by various Federal, State and local revenues; exempt the contracts from\nthe six-month advance notification requirement under Board Policy No. 5.100\nwhen the DMH does not have delegated authority to extend the term of the\ncontract; and authorize the Director of Mental Health to take the following\nactions: (Department of Mental Health) APPROVE\nExecute new contracts with qualified providers for SMHS, provided that,\nsufficient funds are available, the terms of the contracts will be effective\nupon execution and with the same term as these contracts;\nExecute future amendments to the contracts with an option to extend\nthereafter for one additional Fiscal Year through June 30, 2027 to revise\nthe language, add, delete, modify, or replace the service exhibits and/or\nstatement of work, reflect Federal, State and County regulatory and/or\npolicy changes, revise the annual MCAs, provided that the total payment\nor each contract will not exceed an increase of more than 25% of the\napplicable MCA and sufficient funds are available; and\nMake non-material modifications to the contracts through administrative\namendments or change notices for the following and other similar\nreasons, as appropriate, change the contractor’s business name and/or\nheadquarter address, change, revise, add, or delete the contractor’s\nprovider site addresses, site numbers, and/or site names, make technical\ncorrections, revise County and contractor administration exhibits, and/or\nshift funds between currently contracted funded programs, so long as\nsuch shifts will not cause an increase in the MCA; and terminate the\ncontracts in accordance with the termination provisions, including\ntermination for convenience.
