42. Elderly Nutrition Program Services Sole Source Subawards\nRecommendation: Approve and authorize the Director of Aging and Disabilities\nto award and execute non-competitive Elderly Nutrition Program (ENP)\nSubawards, with 10 current governmental subrecipients, effective July 1, 2024\nthrough June 30, 2025 and subsequently execute up to three annual renewal\noptions with six month-to-month extension options, for a maximum Subaward\nterm of four years and six months for the combined estimated annual amount of\n$4,904,000; allocations to the subrecipients subject to the availability of funding\nand are contingent upon each subrecipient’s performance in meeting the goals\nof ENP, as well as each subrecipient’s adherence to its Subaward terms; and\nauthorize the Director of Aging and Disabilities to take the following actions:\n(Aging and Disabilities Department) APPROVE\nExecute amendments with these subrecipients, which serve the best\ninterests of the County during the Subaward term, add new, relevant, or\nupdated Federal, State, and/or County Subaward terms and conditions\nand increase or decrease the Subaward amounts (including but not\nlimited to baseline funds, one-time-only funds, and supplemental monies,\nand/or other new funding sources), which may exceed 10% of the\nMaximum Subaward Amount, in response to the availability of funding\nand/or based on Subrecipient’s performance, provided that the total\nallocation does not exceed available funding;\nIncrease or decrease each subrecipient’s unit rates for ENP Subawards\nat the sole discretion of the Director subject to the availability of funding\nand/or subrecipient’s performance; and\nTerminate Subawards with subrecipient upon their request, and those\nthat have closed or are in default of their subaward requirement, for\nsubrecipient default or for the convenience of the County.
