20. Establishing a Care First Pretrial Agency: Maximizing the Impact of the\nJustice, Care and Opportunities Department\nRecommendation as submitted by Supervisor Mitchell: Instruct the Director of\nJustice, Care and Opportunities to report back to the Board in writing within 60\ndays on the Department’s plans and timeline for establishing a Care First\nindependent pretrial services agency as a distinct division within the Justice\nCare and Opportunities Department (JCOD) that prioritizes and coordinates\nservice delivery with outcomes that are accessible, viable and measurable,\nwhile continuing to reject the use of JCOD staffing or funding in furtherance of\nfunctions, such as surveillance and an electronic monitoring program; and take\nthe following actions:\nDirect the Chief Executive Officer and the Director of Justice, Care and\nOpportunities, to pause the implementation of the Board’s March 1, 2022\ndirectives to transition the Probation Department’s pretrial functions and\nservices to JCOD (Board Order No. 22 of March 1, 2022), and\ncorresponding impacts to staff, until the Chief Executive Officer and the\nChief Probation Officer perform an analysis on the short and long-term\nimpact on the Probation Department’s staffing challenges; and\nInstruct the Director of Justice, Care and Opportunities, in coordination\nwith the Directors of Health Services, Mental Health and Public Health,\nthe District Attorney, the Public Defender, the Alternate Public Defender,\nthe Sheriff, the Chief Probation Officer, and the Jail Closure\nImplementation Team, to report back to the Board in writing in 60 days\non a proposed plan to assemble and coordinate a Permanent Steering\nCommittee composed of community stakeholders, including people with\nlived experience, experts in creating pretrial services models based on\nnational best practices, former Alternatives to Incarceration workgroup\nvoting members, and other representatives from the Public Safety\nRealignment Team, Gender Responsive Advisory Committee, Jail Closure\nImplementation Team, the Men’s Central Jail Closure Workgroup,\nJCOD’s Pretrial Advisory Committee, and the Reentry Health Advisory\nCollaborative, with the purpose of this steering committee to JCOD being\nto develop and drive forward recommendations to ensure the delivery of\npretrial services are accessible, viable and measurable;\nInstruct the Acting Chief Information Officer to work with the Directors of\nJustice, Care and Opportunities, Health Services, Mental Health, Public Health\nand Economic Opportunities, the Public Defender, the Alternate Public\nDefender, the District Attorney, the Chief Probation Officer, the Sheriff, and\nother relevant Department Heads, and report back to the Board in writing within\n60 days with the available data listed below, as detailed in the motion, and a\nplan to post the data at an aggregate and de-identified level on the Open Data\nPortal and/or the County Pretrial Data Center and include the data in the\nquarterly Pretrial Data Initiative presentations, as follows:\nElectronic Monitoring Program administered in accordance with\nCalifornia Penal Code 1203.016 (Probation Department);\nJCOD Support Center (JCOD);\nPrefiling Diversion Program (JCOD);\nPretrial Services (“PREP 2.0”), broken down by each of the locations at\nwhich the “PREP 2.0” program operates (JCOD); and\nRapid Diversion (RPD) (JCOD); and\nInstruct the Director of Justice Care and Opportunities, in coordination with the\nDirectors of Health Services, Mental Health, Public Health, and Economic\nOpportunities, the Public Defender, the Alternate Public Defender, the District\nAttorney, the Sheriff, and other relevant Department Heads, to report back to\nthe Board annually on how the Department will analyze data to evaluate the\nsuccess of County programs, inform equitable service delivery improvements,\nand set Department priorities.
