65. Utility Agreement\nRecommendation: Acting as the Governing Body of the County Waterworks\nDistricts (Districts), authorize the Director of Public Works to execute utility\nagreements, including any revisions or amendments thereto, with the State\nDepartment of Transportation (State DOT), and to approve projects, which are\nthe subject of the agreements, revisions, or amendments for any construction,\ndesign, inspection, and/or related work by or on behalf of any of the Districts\nnecessary to relocate Districts facilities in conflict with a State DOT project,\nprovided the amount to be paid or reimbursed by a District under any such\nutility agreement does not exceed $330,000; authorize the Director to comply\nwith the California Environmental Quality Act (CEQA) for projects, in connection\nwith the exercise of the delegated authority to execute utility agreements with\nthe State DOT, when one or more of the Districts is acting as a responsible\nagency for the proposed utility agreements, revisions, or amendments\ndescribed herein, determine whether execution of the proposed utility\nagreements, revisions, or amendments are exempt from CEQA or within the\nscope of a previous finding of exemption, review and consider previously\napproved Environmental Impact Reports (EIRs), Mitigated Negative Declarations\n(MNDs) and Negative Declarations (NDs), determine whether or not a project is\nwithin the scope of a previously certified EIR and any approved addenda, or\npreviously adopted MND or ND, determine whether or not a project described in\nan EIR, MND, or ND, would have a significant effect on the environment, make\nfindings pursuant to CEQA guidelines, Section 15091, adopt a mitigation\nmonitoring program pursuant to CEQA Guidelines, Sections 15091 and 15096,\nand file and post notices pursuant to Section 21152 of the Public Resources\nCode; find that the delegation of authority to the Director to enter into utility\nagreements and make necessary findings under CEQA is not a project under\nCEQA; and\nAlso, acting as the Governing Body of the County Waterworks District No. 29,\nMalibu, approve a utility agreement between the County Waterworks District No.\n29, Malibu, and the State DOT, and authorize the Director to execute such\nagreement, including any necessary revisions or amendments thereto, with an\nestimated amount of $43,300 and not to exceed $330,000, to be paid by the\nCounty Waterworks District 29, Malibu; and acting as a responsible agency,\nfind that approval and execution of the utility agreement is exempt from CEQA.\n(Department of Public Works) APPROVE (24-1788)\nPublic Safety
