CONSIDERATION AND APPROVAL OF RESOLUTION NO. 24-181,\nREPEALING RESOLUTION 24-165 AND APPROVING FUNDING\nAMOUNTS FROM AVAILABLE FUNDING GRANTS, AND APPROVING\nAN AMENDED AND RESTATED AGREEMENT WITH COUNCIL FOR\nWATERSHED HEALTH FOR THE MERCED AVENUE GREENWAY\nPHASE II DESIGN PROJECT\nWhile the City council approved this item at the May 14th City Council\nmeeting. The funding sources need to be revised to reflect the Council's\nintent that was submitted at the May 14th Council meeting.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Adopt Resolution No. 24-181, approving an amended and restated\nagreement with Council for Watershed Health (CWH) with a maximum\ncontract sum of $1,508,202. Phase I has been completed pursuant to\nthe original contract and funded by Prop 1 grant funds. The resolution\naddresses the cost and funding associated with Phase II, the Merced\nAvenue Greenway North Construction Documents; 2) shall not impose\na 10% retention requirement; and 3) extend performance period to 2\nyears from effective date of contract; and\n2. Authorize City Manager or designee to negotiate and execute the\namended and restated agreement, approved as to form by the City\nAttorney.\nEnd of Consent Calendar.\n8 of 12
